Jovelle Fine Jewelry operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Jovelle Fine Jewelry is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS AND CUSTOM-MADE JEWELRY

We make every reasonable effort to display and describe our products accurately. However, colors, proportions, textures, finishes, gemstone appearance, engraving depth, and other visual details may appear slightly different depending on screen settings, lighting conditions, photography, handmade production, and the natural characteristics of materials.

Minor variations that are normal for handmade jewelry, natural gemstones, engraving, polishing, casting, or made-to-order production do not necessarily constitute a defect, provided that the product materially corresponds to the product description and the customer’s approved order details.

Product dimensions, weights, chain lengths, stone sizes, and measurements are approximate unless expressly stated otherwise. Minor manufacturing tolerances may occur.

We reserve the right to correct product descriptions, specifications, prices, images, and availability where necessary. However, nothing in this section limits any mandatory consumer rights relating to goods that are defective, unsafe, or not in conformity with the contract.

Many of our products are personalized, engraved, custom-designed, made-to-measure, or produced according to customer-selected specifications. These may include names, initials, dates, fingerprints, handwriting, photographs, emblems, logos, birthstones, ring sizes, chain lengths, metal types, finishes, colors, fonts, and other personalized details.

Customers are responsible for reviewing all product selections and personalization information carefully before submitting an order.

SECTION 3 – ORDERS, PERSONALIZATION AND APPROVAL

When you place an order, you make an offer to purchase the selected product under these Terms. An order becomes binding after we accept it and payment has been successfully authorized or received.

We reserve the right to reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or listing errors, product unavailability, inability to produce the requested design, prohibited or infringing personalization, or an incomplete customization request.

If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled portion of the order.

You are responsible for reviewing and correctly entering all order information, including:

Names, initials and spelling;

Dates and Roman numerals;

Fonts, symbols and engraving instructions;

Ring, bracelet and chain sizes;

Metal type, finish and color;

Birthstones and gemstone selections;

Shipping and contact information;

Customer-supplied photographs, fingerprints, handwriting, logos, emblems and artwork.

We manufacture personalized products based on the information submitted or approved by the customer. A product made correctly according to the submitted or approved information will not be considered defective merely because the customer selected an incorrect spelling, size, date, font, color, material, image or other option.

Where we provide a design proof, production may begin after customer approval. Approval confirms that the customer has reviewed the visible spelling, layout and personalization details. Production limitations, handmade variations and technical adjustments may still apply.

Requests to change or cancel an order must be submitted as soon as possible and are subject to our Refund Policy. Because personalized production may begin shortly after purchase, we cannot guarantee changes or cancellation after production, material preparation, engraving or design work has started.

Purchases and returns are governed by our Refund Policy.

SECTION 3A – PERSONALIZED GOODS AND RIGHT OF WITHDRAWAL

Many products sold by Jovelle Fine Jewelry are made to the customer’s specifications or are clearly personalized.

Where permitted by applicable law, the statutory right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized. This may include, without limitation, engraved jewelry, name jewelry, fingerprint jewelry, handwriting jewelry, custom emblems, custom-sized pieces, and products manufactured according to customer-selected personalization details.

This exception does not affect the customer’s rights where a product is defective, damaged, unsafe, incorrectly manufactured, or not in conformity with the order.

Non-personalized products remain subject to any mandatory withdrawal rights and to our Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

The currency displayed or charged may depend on the customer’s location, selected market, payment provider, or Shopify settings. Currency conversions and amounts shown by banks or payment providers may differ because of their exchange rates or fees.

Applicable taxes may be calculated and displayed at checkout. For international orders, the customer may also be responsible for import VAT, customs duties, brokerage fees or other government charges unless the checkout or product page expressly states that such charges are included.

We do not control charges imposed by customs authorities, banks, card issuers or third-party payment providers.

Nothing in this section permits us to add undisclosed mandatory charges after the order has been placed.

SECTION 5 – PRODUCTION, SHIPPING AND DELIVERY

Because many products are personalized or made to order, production time is separate from shipping time. Estimated production and delivery periods shown on the website, product page, checkout or order confirmation are estimates unless we expressly guarantee a specific delivery date in writing.

Delivery may be affected by carrier delays, customs processing, weather, public holidays, peak seasons, incorrect address information, security inspections and other events outside our reasonable control.

We remain responsible for fulfilling the order in accordance with applicable consumer law. For consumers in the European Union, the risk of loss or damage generally passes to the customer when the customer or a person designated by the customer, other than the carrier, physically receives the goods. Where the customer independently commissions a carrier that was not offered by us, different rules may apply as permitted by law.

Customers must provide a complete and accurate shipping address. Please contact us immediately if an address correction is required. We cannot guarantee that an address can be changed after the order has been processed or shipped.

If a package is returned because of an incorrect or incomplete address, refusal of delivery, failure to collect it, or failure to pay applicable import charges, additional shipping or handling charges may apply, subject to applicable law and our Refund Policy.

Customers should notify us promptly if tracking shows delivery but the package has not been received, or if the package arrives visibly damaged. We may request photographs, packaging information, carrier documentation or a signed statement to investigate the claim.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Jovelle Fine Jewelry, its affiliates or licensors and are protected by applicable copyright, trademark, design, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Jovelle Fine Jewelry, Shopify or any third party. Unauthorized use of the Services may be a violation of applicable intellectual property laws. All rights not expressly granted herein are reserved by Jovelle Fine Jewelry.

Customer-Supplied Content

When you submit a name, photograph, fingerprint, handwriting sample, logo, school emblem, family crest, monogram, design, text, symbol or other material for use in a personalized product, you represent that:

You own the material or have permission to use it;

Its use does not infringe any copyright, trademark, privacy, publicity or other rights;

The material is lawful and may be used for the requested purpose; and

You have obtained any necessary consent from persons represented in the material.

You grant Jovelle Fine Jewelry a limited, non-exclusive license to reproduce, modify, format and use the submitted material solely as reasonably necessary to design, manufacture, fulfill and provide customer support for your order.

We may refuse a personalization request that appears unlawful, infringing, abusive, hateful, misleading or otherwise inappropriate.

You are responsible for claims arising from material you submitted without the necessary rights or permissions, except to the extent that liability cannot legally be imposed on you under applicable consumer law.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Jovelle Fine Jewelry is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Jovelle Fine Jewelry. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Jovelle Fine Jewelry, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Jovelle Fine Jewelry.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.

Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

If an error affects an order already placed, we will contact the customer and provide an appropriate lawful solution. Nothing in this section permits us to cancel or alter a concluded consumer contract in a manner prohibited by applicable law.

You may access and use the Services for lawful purposes only. Termination or suspension of website or account access does not affect any order already accepted by us, except where cancellation is permitted by these Terms, our Refund Policy, or applicable law. If we lawfully cancel a paid order, we will refund the amount due for the cancelled portion of that order.

The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

For eligible consumer purchases in the European Union, goods are covered by the applicable legal guarantee for lack of conformity. Where legally required, customers may be entitled to repair, replacement, price reduction or termination of the contract and refund.

These Terms and any contract concluded through the Services are governed by the laws of Belgium, without prejudice to any mandatory consumer protection rights that apply under the laws of the country in which the consumer habitually resides.

If you are a consumer residing in the European Economic Area, the United Kingdom or another jurisdiction that provides mandatory local consumer protections, nothing in these Terms deprives you of those protections.

Any dispute will be handled by the competent courts determined under applicable law. Nothing in these Terms requires a consumer to bring a claim exclusively before a court that would not otherwise have jurisdiction under mandatory consumer law.
